RĒSUNIX inc. is committed to protecting personal information in accordance with Law 25, PIPEDA and applicable laws in Quebec and Canada.

2. Applicable legal framework

This policy is established in compliance with the following laws:

  • Quebec — Act to modernize legislative provisions respecting the protection of personal information (Law 25, S.Q. 2021, c. 25)
  • Canada — Personal Information Protection and Electronic Documents Act (PIPEDA, S.C. 2000, c. 5)
  • European Union — General Data Protection Regulation (GDPR, EU Regulation 2016/679)
  • United States — California Consumer Privacy Act (CCPA, Cal. Civ. Code § 1798.100 et seq.)
  • Civil Code of Quebec (C.C.Q.) — provisions relating to privacy (art. 35 to 41 C.C.Q.)

3. Information collected and purposes

RĒSUNIX inc. collects only information voluntarily provided through the contact form, for the following purposes:

  • Name or organization — identify the contact and qualify the request
  • Phone number (optional) — enable telephone follow-up upon request
  • Sector of activity — tailor the response to the operational context
  • Description of need — assess the nature and scope of the potential mandate

In accordance with article 8 of Law 25, information is collected only to the extent necessary for the declared purposes.

The RĒSUNIX website uses no cookies, no analytics tools, no trackers and no third-party services.

4. Legal basis for processing

The processing of personal information rests on the following legal bases:

  • Explicit consent — the user voluntarily submits the contact form (Law 25, art. 13)
  • Legitimate interest — processing necessary to respond to professional requests received
  • Contract performance — processing required within the scope of agreed mandates

Consent may be withdrawn at any time by contacting the Privacy Officer at privacy@resunix.ca.

5. Use and sharing of information

Information collected is used exclusively to respond to requests, assess needs and follow up on RĒSUNIX inc. mandates.

No personal information is sold, rented, exchanged or shared with third parties, except as expressly required by law.

6. Transfer outside Quebec

The RĒSUNIX website is hosted and operated entirely in Canada, in data centers located in Quebec and Ontario, for resilience and operational continuity purposes. No personal information is transferred outside Canada.

Hosting is provided by OVH Canada, subject to the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Canadian laws, in accordance with article 17 of Law 25.

7. Retention and destruction

Personal information is retained for a maximum of 2 years following the last contact or the end of the mandate, whichever occurs last.

Upon expiry of this period, information is securely and permanently destroyed, in accordance with article 23 of Law 25.

8. Security

RĒSUNIX inc. implements appropriate technical and organizational security measures to protect personal information against loss, theft, unauthorized access, disclosure, copying, use or unauthorized modification.

9. Privacy incident

In the event of a privacy incident, RĒSUNIX inc. commits to:

  • assess the severity of the incident and the risk of serious harm;
  • notify the Commission d'accès à l'information du Québec (CAI) if a serious risk of harm is established, in accordance with article 3.5 of Law 25;
  • notify affected individuals as soon as possible;
  • record the incident in an internal register.

10. Rights of data subjects

In accordance with applicable laws, any individual may exercise the following rights:

  • Access — obtain a copy of information held (Law 25, art. 27; GDPR, art. 15)
  • Rectification — have inaccurate information corrected (Law 25, art. 28; GDPR, art. 16)
  • Deletion — request erasure in cases provided by law (Law 25, art. 28.1; GDPR, art. 17)
  • Portability — receive information in a structured, machine-readable format (Law 25, art. 27; GDPR, art. 20)
  • Withdrawal of consent — at any time, without prejudice (Law 25, art. 14)

Response time: 30 calendar days from receipt of the request, in accordance with article 30 of Law 25.
